Agreement to Terms
By accessing or using the EcoAdventures Canada website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
Description of Services
EcoAdventures Canada provides coordination services connecting Canadian travellers with Indigenous-led and community-operated tourism experiences. We are not tour operators. Our role is limited to:
- Vetting community operators for authenticity and fair practices
- Coordinating connections between travellers and operators
- Facilitating logistics and scheduling arrangements
- Providing information about available experiences
We do not own, operate, or control the tourism experiences themselves. Community operators are independent entities responsible for their own operations.
User Responsibilities
When using our coordination services, you agree to:
- Provide accurate and complete information about your interests and requirements
- Respect cultural protocols and community guidelines provided by operators
- Behave respectfully toward community hosts, operators, and other participants
- Follow environmental and safety guidelines provided by operators
- Honor scheduling commitments and cancellation policies
- Pay operators directly and fairly for their services
- Not use our services for any unlawful or prohibited purpose
Limitations of Liability
EcoAdventures Canada serves as a coordination service only. We are not liable for:
- The quality, safety, or suitability of experiences provided by community operators
- Actions, omissions, or negligence of community operators or other participants
- Injuries, losses, damages, or expenses incurred during experiences
- Changes, cancellations, or disruptions caused by weather, natural events, or operator circumstances
- Cultural misunderstandings or protocol violations by travellers
- Disputes between travellers and community operators
Your participation in coordinated experiences is at your own risk. We strongly recommend obtaining appropriate travel and medical insurance.
No Guarantees
While we carefully vet community operators, we make no guarantees regarding:
- Availability of specific experiences or operators
- Weather conditions or seasonal variations
- Outcomes or satisfaction with coordinated experiences
- Compatibility between travellers and operators
Coordination Fees and Payments
Our coordination fee is separate from payments to community operators. You pay operators directly for their services. Our fee structure will be clearly explained before any coordination services are provided. Fees are non-refundable once coordination work has begun, though operator payments may be subject to their own cancellation policies.
Cancellations and Changes
Experiences may be cancelled or modified due to:
- Weather conditions or natural events
- Operator availability or circumstances
- Cultural calendars or community decisions
- Safety concerns or unforeseen events
Cancellation policies are set by individual community operators. We will communicate these policies clearly and assist with rescheduling when possible, but we are not responsible for refunds or compensation related to cancellations.
Cultural Sensitivity and Respect
Many experiences we coordinate involve Indigenous communities and cultural practices. You agree to:
- Follow all cultural protocols and guidelines provided by operators
- Respect community decisions about what can be photographed or shared publicly
- Understand that some practices or ceremonies may not be available to visitors
- Recognize that communities have the right to decline or terminate visits at any time
Violations of cultural protocols may result in immediate termination of your experience without refund.
Intellectual Property
All content on the EcoAdventures Canada website, including text, images, logos, and design elements, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our explicit permission.
Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
Indemnification
You agree to indemnify and hold harmless EcoAdventures Canada, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of our coordination services
- Your participation in coordinated experiences
- Your violation of these Terms of Service
- Your violation of any rights of community operators or other parties
Dispute Resolution
These Terms of Service are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these terms or our services shall be resolved through:
- Good faith negotiation between the parties
- Mediation, if negotiation is unsuccessful
- Binding arbitration in Montreal, Quebec, if mediation fails
Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified terms.
Termination
We reserve the right to refuse service or terminate coordination arrangements if we believe you have violated these terms, behaved disrespectfully toward community operators, or engaged in conduct that could harm our relationships with community partners.
